ORDER AND DELIVERY TERMS

1. General

KJR Equitation Oy (hereinafter "KJR ") operates an e-commerce service (hereinafter the "Webstore") located at www.kirjorinne.com for purchasing of equine related products and services.   KJR offers both physical products ("Physical Products") and intangible products, such as training and coaching services, webinars and digital materials, ("Intangible Products") through the Webstore.

These terms and conditions apply to the Webstore and to the content and functionality of the Webstore and to any products offered through the Webstore. The terms and conditions valid at a given time are available on the www.kirjorinne.com website.  In addition to these terms and conditions, the Webstore is subject to the terms of use applicable to KJR 's websites which also form an integral part of these terms.

By using any part of the Webstore or associated content, the website user ("Customer") accepts the currently valid terms and conditions applicable to the Webstore. If the Customer does not agree to be bound by these terms or cannot comply with them, the Customer should cease all use of the Webstore.

KJR reserves the right to change these terms by announcing the changes in the Webstore or their websites.

The Products available in the Webstore are meant for the personal use of the Customer, not retail sales. KJR makes separate distribution agreements with distributors.

2. Access to the Web Store

KJR grants the Customer a limited, revocable, non-exclusive, non-transferable license to access the Webstore. This license does not include a right to use any of the content and information, including product listings.

3. Customer's details

The Customer must be 18 years of age to place orders in the online store. The Customer can place an order by providing the necessary details requested. If the Customer is a company or other legal entity, the representative of the Customer shall confirm that the representative is entitled to represent the entity either under the law, representation based on position or by power of attorney, and is of legal age and has legal capacity to enter into the agreement.

To place orders, the Customer must inform the following details: name/ company name, name of the representative, address, functioning email address and phone number. The Customer is responsible for ensuring that the data they provide to KJR is accurate and up to date. The provided information is handled as confidential and is not disclosed to third parties.

In its capacity as the controller, KJR processes Customers' personal data as permitted and obligated by the currently valid legislation applicable to the processing of personal data. Further information about the processing of personal data is available in KJR 's Privacy Statement.

4. Order

The products are ordered from the Webstore. The products are ordered by adding them to the shopping basket in the Webstore and paying for them in the Webstore's checkout. The Customer is advised to check the contents of the shopping basket before submitting the final order. An order subject to a payment obligation binding on the Customer is generated when the Customer submits their order in the Webstore and the Customer has approved these terms and other applicable terms. Following this, the Customer will receive an automatic confirmation of their order to the email address they have provided

The order becomes binding on KJR once it has been separately confirmed by KJR. By placing an order at the Webstore the Customer accepts the use of their personal data.

KJR retains the right not to accept an order if, for example, KJR has reason to doubt the solvency of the Customer. KJR may also use this right after submission of the order confirmation. KJR endeavours to notify the Customer of the matter as soon as possible. The Customer is not entitled to cancel the order apart from the situations separately mentioned in the order and delivery terms. An order that concerns personalised or custom-made products cannot be cancelled after their production has commenced.

5. Availability

KJR aims to ensure that the online store provides accurate and up-to-date information about products, but cannot guarantee the correctness of the information or the availability of products. Some of the products on sale in the online store may be available only for a limited period of time. A product displayed in the online store may also be temporarily out of stock or sold out.

It is possible that the availability of a product displayed in the online store and shopping basket changes prior or subsequent to the payment transaction. KJR will contact the Customer in the event that KJR is temporarily or entirely unable to deliver the ordered product. If the product cannot be delivered at all and the Customer does not wish to have a replacement product, KJR reimburses the Customer for the sum total of the order.

6. Personal data and the use thereof

The personal and company information of the Customers using the Webstore are collected and recorded in the customer register maintained by KJR. The use of personal data is described in the privacy statement. Personal data is mainly collected to facilitate use of the Webstore and the delivery of the products.

7. Product prices

The product prices shown in the Webstore are retail prices valid until further notice or for a separately mentioned period of time (such as campaign prices and discounts). The prices are inclusive of Finnish value added tax (currently 24%) and presented in EUR.

The prices of the products do not include shipping costs or any other possible handling or additional costs, which will be shown separately in the Webstore's checkout prior to the approval of the order. The same itemisation will also be shown in the order confirmation sent to the Customer. The prices displayed in the online store are valid only in the Webstore.

KJR reserves the right to make changes to prices and costs, although in such a way that the changes have no effect on orders already made. If the Webstore displays an incorrect price which differs from the actual price to a significant degree or is exceptionally low in comparison to the general price level, the price displayed incorrectly is not binding on KJR.

8. Payment

Payment processing is made through KJR's service provider's, Paytrail Plc secure payment services ("Payment Service"). 

Payment Service Provider Paytrail Plc acts as a collecting payment service provider and is an authorized Payment Institution. Paytrail Plc will be shown as the recipient on your bank or credit card statement. Paytrail Plc will forward the payment to the merchant. For reclamations, please contact the website the payment was made to.

Additional terms and conditions may apply to using the Payment Service and Paytrail may need to collect and process your personal data in order to finalize the Order, verify your payment or for other similar purposes. By placing an order you accept and agree to the terms applicable to the Payment Webstore, which will form part of your agreement with KJR. For clarification, KJR does not have any liability over the data collected and processed by Paytrail through the Payment Service or for any malfunctions, errors or other defects concerning the Payment Service. The general terms and conditions of the Payment Service can be reviewed here. Payment is also possible via PayPal. 

Any possible benefit codes offered by KJR to the Customer, entitling them to a product or order-specific discount or free delivery, can also be used in connection with payment.

9. Delivery times and fees

The estimated delivery time is stated in connection with the order confirmation, on these terms or on the Webstore. The provided delivery time estimate is not binding on KJR.

The Products will be delivered to the address provided by the Customer. The Customer is responsible for the accuracy of the delivery address.

The order is delivered according to the delivery method selected by the Customer. Once the products have been packaged at KJR 's warehouse and are ready to be shipped, the Customer will receive a delivery confirmation in their email address.

The delivery costs are EUR 6.90 at the minimum and are subject to the features and amount of the ordered product and chosen shipping method. The delivery costs and different shipping options will be provided to the Customer before order confirmation on the Webstore.

KJR aims to deliver the ordered products on time and within a single shipment. KJR nevertheless has the right to deliver the products to the Customer in separate shipments. In some cases, the delivery methods may vary according to the destination country.

If the Customer fails to collect the delivered product within a set period of time from the delivery location and has not informed KJR of their intention to exercise their right of cancellation, KJR is entitled to charge a fee from the Customer equal to its delivery costs, return costs and other possible costs incurred in relation to the delivery.

Delivery of Physical Products

The usual delivery times to Finland are for Physical Products from 5 to 7 business days from the date of the order. The products are shipped within 3-5 business days from the date of the order. The delivery times outside of Finland vary depending on the delivery country.

Delivery of Intangible Products

The Intangible Products are delivered in accordance with the product description. The Intangible Products, such as online trainings, shall be available for use within a restricted period of time from the payment date. In most cases the Intangible Services are available for three (3) months from the payment date unless otherwise informed in the product description. Digital materials are made available in accordance with the product description either by allowing the download of the digital materials from the online store or by sending the digital materials or the links and other access details to the provided email address.

Delivery of custom-made products

Please note that in the case of custom-made products, we are always in touch with the delivery time on a case-by-case basis.

10. Digital materials

The digital materials may include digital audio, image, text or other media files or other materials and information in a digital form. By purchasing digital materials the Customer is granted with a right to use the digital materials in their personal, non-commercial use unless otherwise specified in these terms. No other rights to the digital materials are granted to the Customer.

If the Customer is a professional or a company, the digital materials may be used only by the said professional in their own commercial activities and/or in internal use of the company or for educational purposes. In any case, the digital materials may not be copied, reproduced, modified, distributed, offered for sale or otherwise commercially utilized without prior written consent of KJR

11. Defects and complaints

KJR is responsible for any product defects in accordance with the currently valid, applicable legislation.

The Customer must check the accuracy of the delivery immediately upon receipt of the delivery. If the Customer suspects that the product is faulty or the delivery is incomplete, all complaints regarding the order and delivery are requested to be sent within seven (7) days of receipt of the order. If the ordered products are incorrect and the Customer wants to make a complaint, the Customer should contact KJR's customer service by sending an email to: niina@kirjorinne.com. KJR does not process complaints received more than 7 days after receipt of the product.

If a defect is discovered in the product, KJR will repair the defect in the manner it deems best by i) delivering a flawless or substitute product to replace the defective product; or ii) cancelling the sale of said product and reimbursing the product price to the Customer. 

The Customer is not entitled to make a complaint in terms of a product defect attributable to KJR having delivered the product and its personalised content in accordance with the Customer's instructions.

12. Right of cancellation

The Customer has the right to cancel an order no later than within 14 days of receiving the ordered product. However, the right of cancellation cannot be exercised if the product in question has been made or modified according to the Customer's requirements (a customised product).

If no notice of cancellation is received, the order is considered valid and its individual manufacture can be started. If 14 days have been exceeded and production has begun, the customer can still cancel the order, but in that case KJR will only refund the part of the price of the product that remains in relation to the materials and manufacturing costs.

The Customer does not have the right to cancel the transaction if the delivery of digital materials, training or other Intangible Products has already started or has been completed with the Customer's consent before the end of the 14-day cancellation period or if the Customer has been notified of the early delivery in advance. The orders of digital materials cannot be cancelled if the access details to the digital materials have been sent to the Customer or the digital materials have been made available for downloading in connection with or immediately following the order confirmation.

If it has been agreed with the customer that the production of the product will start earlier than after 2 weeks, the possibility of a 14-day cancellation is not applicable.

Refunds related to the cancellation of Intangible Products are as follows, unless otherwise stated in the description of the service in question:

• If the cancellation of participation in a training and / or digital content has been made 14 days before the delivery date of the service, the paid training fees will be refunded in full to the Customer;
• If the cancellation of participation in a training and / or digital content is made later than 14 days before the delivery date of the service, 50% of the paid training fees will be refunded to the Customer.

For the return of a service consisting of several service components (for example, several trainings), the conditions are as follows:

• A service consisting of several parts of a service shall be considered as a single entity and shall be subject to the same cancellation conditions as a single service; and
• Payments made for training and / or digital content already provided or started will not be refunded

13. Procedure when exercising right of cancellation

If the Customer wishes to cancel an order, the Customer must return the product to KJR in accordance with these terms.

Please note that the mere return of the goods, or failure to collect the package without separate notice, does not fall within the scope of the right of cancellation. If the order is not returned in accordance with these terms or the order is returned due to failure to collect the package, KJR will charge the costs of delivery and handling of € 20.00, in which case the customer will be reimbursed for the remaining part of the value of the order.

Before returning the product, the Customer shall contact KJR by email or phone and they will be provided with return instructions. Once the Customer has received a confirmation from KJR's customer service for the return, the order can be returned. The return package shall include the following information: a copy of the order receipt or list the products to be returned, as well as your contact information (name, address, telephone number and account number).

Returns must be sent by regular mail with freight paid for. The seller will not reimburse the return shipping costs.

The use of the right of cancellation requires the product to be in its original package and re-saleable and the product or its package not to bear signs of use. If the returned product has been used contrary to the Customer's statutory duty of care, KJR has the right to charge the reduction in value all the way up to the product's full price.

After an approved return, we will refund the transaction amount within approximately 7 days. If the transaction was made by direct debit or bank transfer, we need an account number for a refund. Transactions where Paytrail or PayPal payment has been used will be handled back payment through their service.

KJR may withhold the return of payments until it has received the cancelled product or until the Customer has proved that they have returned it.

14. Intellectual property rights

All rights to the content and the products of the Webstore belong to KJR. All material on the website (such as texts, pictures, logos, trademarks, digital proudcts and other protected material) is the property of KJR. Copying or use of the material is forbidden without the explicit consent of KJR unless otherwise stated in these terms. 

If KJR has completed a personalised order, on the Customer's request, the Customer warrants that the material or content it has delivered for the personalised product is not contrary to generally accepted good practices and does not infringe upon the rights of third parties. The Customer shall be liable to KJR for all damage or loss incurred by KJR as a result of the material or content delivered by the Customer or from the fact that it violates generally accepted good practices or the rights of third parties. KJR retains the right to not accept or deliver an order for a justified reason, such as, if the personalised order is, in KJR 's view, contrary to generally accepted good practices.  

15. Limitation of liability

KJR does not guarantee uninterrupted operation of the Webstore. The same restrictions apply to the Webstore that apply to the Internet in general; for example, simultaneous connections from many users may cause congestion in the Webstore and affect its availability. KJR shall not be liable if the Customer's order is not received as a result of inactivity of the information network or data connections. KJR shall not be liable for any delays caused by force majeure. Furthermore, KJR shall not be liable for any errors occurring during the delivery. 

KJR shall not be liable for any indirect or consequential damage or loss. KJR 's liability is in all circumstances limited to the value of the defective/delayed/missing products. 

KJR is not liable for a delayed delivery or other breach of agreement attributable to force majeure.

16. Applicable law and settlement of disputes

These terms and conditions are subject to Finnish law, with the exception of its conflict rules, unless otherwise required by the mandatory legislation of the Customer's domicile. The parties shall attempt to settle any disputes arising from these terms and conditions or the application thereof primarily through negotiations. If the negotiations do not lead to a settlement, the disputes are settled in the District Court of Kokkola, Finland.  

These terms and conditions are subject to Finnish law, with the exception of its conflict rules, unless otherwise required by the mandatory legislation of the Customer's domicile.

However, the Customer may refer the dispute to the district court of their domicile or other body handling consumer disputes in their domicile. In Finland, this body would be the Consumer Disputes Board. Prior to referring the matter to a court of law or some other body settling consumer disputes, the Customer is advised to contact the consumer advisory Webstores of their own country.

In addition, the Customer has the right to seek a settlement outside a court of law for a dispute concerning a purchase they have made online through the Online Dispute Resolution (ODR) forum maintained by the European Commission.
